SELLING CAN CREATE PROBLEMS
Sometimes A Sale Is Not A Sale
|

|
Most people would generally agree that whilst purchasing can often
require a good deal of thought before making a decision to buy, selling
usually may be a very simple operation; - Simply find a buyer and
collect the cash at the end of the deal. As a lot of shrewd businessmen
have quoted down through the centuries; - a sale is not a sale until the
money is in the bank. Well this saying is simple enough to comprehend,
as many people are big on words, but small on action, when it comes to
actually making the move to purchase. |
No real problem you say, the buyer may
still have his cash, but I still hold the item for that is for sale, but serious
problems can arise when there is another party who is having some input into the
whole deal.
A Case In Point
Let us consider a case of two business partners
mutually agreeing to sell their large business after many years of profitable
operation. They duly engage the services of a relatively well known company, who
can both market their business and then with their in house ‘lawyer,’ the
transaction could be smoothly and easily completed. Buyers are found and they
pay the required deposit, and everything is going along just fine, and then
comes the time for the final payment, and the handing over of the final legal
documents. Well all of this takes place as expected, so where does a problem
occur? It appears that for whatever reason, the lawyer simply does not hand over
the funds to the previous owners, so naturally they decide to do something about
the situation. However, at this point the lawyer makes it clear in no uncertain
terms that he had some very powerful connections in the criminal world and also
in the enforcement business. Furthermore, any attempts to recover the money owed
to the sellers, could result in their untimely demise from this world, or a
similar equally uncomfortable situation. These powerful threats were sufficient
to frighten the previous owners into dropping ideas of trying to collect the
substantial amount of cash, which is rightfully owed to them. (It is indeed
ironic that engaging someone to make things easier for you, can sometimes be the
start of some very serious problems if they are not trustworthy).
Cure, Cause And
Prevention
The rectification of the above
scenario is not a simple and straight forward matter, as the sellers would
initially have to ascertain if the so called lawyer was in a position to carry
out the threats that he had made. Even taking the matter to a senior anti
corruption department in Bangkok could see some of the threats carried out, and
while the financial expenditure would be worthwhile, this would all take time,
not to mention the inconvenience.
When it comes to identifying the cause
of the problem, this is easy to identify; - simply do not get mixed up with
shady business operators who may not be even qualified to do legal work. This
leads on to the question of prevention, which is a matter of choosing the right
people in the first place, so you may well ask; - Well is a relative newcomer to
the area, how do I know? The answer is to locate professional advisors, who have
had many years of local experience in the business, and although they may make a
small service charge, they are not trying to ‘rip you off.’
